Charges for Car Rentals: Information on the Refund Procedure by Sixt Rent a Car

The Court of Bolzano, with a ruling dated November 4, 2024, in the representative action initiated by Movimento Consumatori, declared some clauses adopted by Sixt Rent a Car S.r.l. to be unfair.
MC and Sixt have agreed on a procedure for refunding amounts paid for charges imposed under the following contractual clauses contained in rental agreements signed after 30 November 2021, and applied starting from December 1, 2021:
• Clause J.4, which imposed a charge (“onere forfettario”) for each fine, toll payment, or parking charge received by the customer, amounting to €31.97 up to 10 January 2023, and €25.00 plus VAT thereafter.
• Clause K.7.b), which imposed a fixed penalty of €500.00 for each case of delayed vehicle return, with the possibility of requesting additional compensation for damages, in addition to paying the contractual penalty.

To obtain a refund of the amounts paid, it is necessary to complete the form provided by Sixt Rent a Car S.r.l., available at the following link: https://www.sixt.it/files/legal/Modulo_Rimborso_Bilingue.pdf, attaching proof of payment made to the company.

MC has also agreed on a consultation procedure for any disputes between consumers and Sixt regarding the request for refunds for the charges mentioned above and any other possible issue between Sixt and its customers for the period of one year.
