The court of Trento, with a judgement of 3 may 2024, declared the unfairness of the clauses applied by Autovia s.r.l., which provide for the application of unlawful penalties in the event of violation of the Traffic Code by the user of the vehicle or in case of accidents.
The court upheld Movimento Consumatori claims and ordered the company to inform, by means of an individual notice, all consumers of the voidness of the penalties and the consequent right to obtain the full refund of the amount paid.
For over ten years, Autovia has charged tens of thousands of consumers a penalty of 60 euros for each fine and 30 euros for each missed toll, as well as penalties of up to 183 euros for each accidents. These are unlawful and unjustified amounts. In the 2018-2020 period, it can be estimated that the company has thus collected more than 3 million euros only for the first one penalty.
