The court of Bolzano, with a judgement of 19 June 2024, declared the unfairness of the clauses applied by Goldcar Italy s.r.l., which provide for the application of unlawful penalties in the event of violation of the Traffic Code by the user of the vehicle or in case of missing refuel at the end of the rental period.

The court upheld Movimento Consumatori claims and ordered the company to inform, by means of an individual notice, all consumers of the voidness of the penalties and the consequent right to obtain the full refund of the amount paid. 

Goldcar has charged tens of thousands of consumers a penalty of € 55 (since 2023 € 24,40) for each fine as well as a € 50 penalty for failure to refuel for over ten years. This amount is unlawful and unjustified. In the 2018-2021 period, it can be estimated that the company has collected more than 5 million euros only for the first one penalty.
