The court of Bolzano, with a judgement of 17 June 2024, declared the unfairness of the clauses applied by Sicily by Car s.r.l., which provide for the application of unlawful penalties in the event of violation of the Traffic Code by the user of the vehicle.

The court upheld Movimento Consumatori claims and ordered the company to inform, by means of an individual notice, all consumers of the voidness of the penalties and the consequent right to obtain the full refund of the amount paid.

Sicily by Car has charged tens of thousands of consumers a penalty of € 61 for each fine for over ten years. This amount is unlawful and unjustified. In the period 2018 - 2020 it can be estimated that the company has collected more than €10 million, applying the penalty.
